In using this website you are deemed to have read and agreed to the following terms and conditions:


The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", “You” and “Your” refers to you, the person accessing this website and accepting ProCare Sports Medicine’s terms and conditions. "ProCare Sports Medicine ", “Ourselves”, “We” and "Us", refers to our Business. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of ProCare Sports Medicine stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.



Privacy Statement

We are committed to protecting your privacy. Authorised employees within ProCare Sports Medicine on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.


ProCare Sports Medicine is committed to protecting the privacy and security of your personal information. This notice explains how we put that commitment in practice by explaining how we collect your personal information through our treatment services. This includes visits to our website, enquirers by phone, email or in person. This notice explains the types of personal information we hold and how that information is used.

ProCare Sports Medicine, as defined by the General Data Protection Regulation (GDPR) is a data controller. This means that we are responsible for deciding how we hold and use personal information about you. We are required to notify you of the information contained in this privacy notice.

It is important that you read this notice, together with any other privacy notice we may provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information.


Principles of Data Protection

In the performance of our business we will comply with data protection law. This means that the personal information we hold about you must be:

1. Used lawfully, fairly and in a transparent way.

2. Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.

3. Relevant to the purposes we have told you about and limited only to those purposes.

4. Accurate and kept up to date.

5. Kept only as long as necessary for the purposes we have told you about.

6. Kept securely.


The kind of information we hold about you

Personal data that we may collect from you will usually include contact details such as your title, name, address, date of birth, telephone number, e-mail address, and medical insurance details. We also hold GP & Consultant details, details of treatment provided, which may include sensitive, personal information such as medical information. We may also collect your IP address when using our website.

Through your treatment we may also use images and videos to record your movements in assessing your physical/medical conditions for the purpose of the services we are providing. This is solely for your benefit and is deleted afterwards and only shared with you.


How your personal information is collected

We collect information from you when you book with us and register for treatment, throughout your treatment, and through our use of cookies online.

We may also collect subsequent personal information when you contact us directly by telephone, email or through social media.

We may also get information from a third party who books an appointment on your behalf, such as family members, insurance companies, GP’s and Consultants, (e.g. referrals, medical reports, updates after appointments or procedures/surgery, consultant/GP appointments).


Collection and use of children’s personal information

We only collect personal and medical information required to effectively treat children, this information will be obtained from the parent or guardian chaperoning the child for their appointment, records will be stored in line with Data Protection laws and all the confidentiality guidelines issued by the professional bodies such as CSP. From the age of 16 patients can consent themselves.


How we use your personal data

We will only use your personal information when the law allows us to.  Most commonly, we will us your personal information for the direct purpose of providing your treatment. We use your data for our medical and internal record keeping. We may also use your personal information in response to any communication you may have with us, and to remind you of appointments. Where we process special categories of personal data (sensitive personal data), we will do so where applicable law allows us to in pursuance of our legal and professional obligations.


From time to time, we may use your personal information to send you news, updates and promotional offers but will usually only do so where you have actively agreed or asked to receive such information or if we are sending you information about services similar to those you may have received from us before.

If you wish to stop receiving marketing information from us, please contact us to inform us of this as we do not wish to send you information you do not wish to receive. In the event that we email you, there will also be a link to click on to opt out of receiving any further marketing or emails from us.

In some cases, we may use your personal information to pursue legitimate interests of our own provided your interests and fundamental rights do not override those interests. In other circumstances we may be required to process your information by law, e.g. for the prevention of fraud or crimes or if it is necessary to protect your interests or those of another person.


Security and standards

We take data protection very seriously and in compliance with the GDPR, we have taken reasonable steps to safeguard your information. We use secure IT systems with encryption where sensitive personal data is concerned. Your medical records are kept in analogue format only and securely kept in a locked cabinet.


Change of purpose

We will only use your personal information for the purposes for which you provided it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.


Data retention

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. For any medical records from your treatments this will be for a period of 8 years. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. 


Your rights in connection with personal information

Under certain circumstances, by law you have the right to:

Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.

Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).

Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.

Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.

Request the transfer of your personal information to another party.

If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact us with a written request either by post or electronically.


Right to withdraw consent

In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please email us at info@procaresportsmedicine.com. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.



We are registered under the Data Protection Act 1998 and as such, any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.


We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by ProCare Sports Medicine will only be in connection with the provision of agreed services and products.



Disclaimer - Exclusions and Limitations

The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, ProCare Sports Medicine:

ProCare Sports Medicine does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.




Cash or Personal Cheque with Bankers Card or BACS Transfer are all acceptable methods of payment. Our Terms are payment in full within thirty days. All goods remain the property of the Company until paid for in full. Monies that remains outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England's base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.


Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.



Cancellation Policy

Minimum 24 hours notice of cancellation required. Notification for instance, in person, via email, mobile phone ‘text message’ and/or fax, or any other means will be accepted subject to confirmation in writing. We reserve the right to levy a £30 charge to cover any subsequent administrative expenses.



Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.




Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of ProCare Sports Medicine. ProCare Sports Medicine does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify ProCare Sports Medicine, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.



Log Files

We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within ProCare Sports Medicine on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.




We may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer’s hard drive. They help us to improve our site and to deliver a better and more personalised service. They enable us:

To estimate our audience size and usage pattern.

To store information about your preferences, and so allow us to customise our site according to your individual interests.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.




Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.




The laws of England and Wales govern these terms and conditions. By accessing this website and using our services you consent to these terms and conditions and to the exclusive jurisdiction of the English courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of ProCare Sports Medicine to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorised representatives of ProCare Sports Medicine.



Notification of Changes

ProCare Sports Medicine reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.


Covid 19 T&Cs 

ProCare Sports Medicine will be open from 10th July 2020 for selected face-to-face physiotherapy consultations. 

We advise that you continue with virtual appointments unless there is a clinical need to have hands on physiotherapy. In order for our clinicians to establish this, you will be required to have a phone call with one of the team to confirm the appointment can go ahead. This is in line with the recommendations from our regulatory bodies The Chartered Society of Physiotherapy: https://www.csp.org.uk/news/coronavirus/clinical-guidance/face-face-or-remote-consultations/guidance-england ;
Our procedures have been amended and safety measures have been put in place to reduce the risk to our staff, patients and general public. We are doing everything we can to reduce the risks but please be aware that there is no way that we can eliminate the risk of you contracting Covid-19. 
* There will only be one Physiotherapist or Clinician working in the clinic per day.
* Appointments will be spaced with 30 minutes between appointments. This will minimise patient overlap, limiting the number of people in the clinic at any one time. It will also enable the clinician to disinfect equipment and all surfaces that have been touched by either the clinician or patient and time to change PPE. This includes, but not limited to: plinths, seat handles, door handles, taps, light switches and toilet facility. 
* Pillow covers will be changed by the clinician between appointments.
* Disposable, single use, couch roll will be used on the couch and pillows.
* The doors to the treatment room and reception will be left open to maximise ventilation (except for when they need to be closed for your privacy).
* Professional cleaners will perform regular deep cleans.

* If you develop any symptoms in the two weeks following your consultation please notify us immediately. 
* Wear a face mask for the entire time that you are in the building. If you do not have a face mask please follow the government guidelines on making your own face covering here: https://www.gov.uk/government/publications/how-to-wear-and-make-a-cloth-face-covering
* Do not come more than 5 minutes prior to your appointment start time. 
* You will be asked to Wash your hands for at least 20 seconds in the clinic at the start of the session or clean your hands with hand sanitiser before you enter the clinic. Hand sanitiser is freely available inside the clinic. 
* Upon arrival, sign the written consent form consenting to treatment in the light of the risk of contracting Covid-19 and understanding that every possible precaution has been taken to avoid contamination. 
* Have your temperature taken to ensure you do not have a fever.
* Maintain a 2 meter distance from anyone else in the waiting area/reception.
* Maintain a 2 meter distance from your clinician for the parts of your session that are possible to do so.
* You will be asked to Wash your hands for at least 20 seconds in the clinic at the start of the session or clean your hands with hand sanitiser before you enter the clinic. Hand sanitiser is freely available inside the clinic. 

We will terminate your appointment if you do not follow the rules and you will still be liable for the full cost of the appointment. 

What to bring -

Please do not attend the clinic if:
* You have been in contact with anyone with Covid-19 symptoms in the last 14 days
* You have had any Covid-19 symptoms in the last 7 days
* You or a member of your household is in one of the higher risk group for Covid-19 
* You have not been following the government guidelines for social distancing advised on: https://www.gov.uk/coronavirus
The NHS currently advises the main symptoms of Covid-19 are:
* high temperature – this means you feel hot to touch on your chest or back (you do not need to measure your temperature)
* new, continuous cough – this means coughing a lot for more than an hour, or 3 or more coughing episodes in 24 hours (if you usually have a cough, it may be worse than usual)
* loss or change to your sense of smell or taste – this means you’ve noticed you cannot smell or taste anything, or things smell or taste different to normal

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
